• User-Generated: Any content or resources created by users of our platform.
• Consent: An affirmative agreement by a user to the processing of their personally identifiable information (PII), which may be revoked at any time.
• Usage Data: Information collected automatically, either generated by the use of the platform or from the platform infrastructure itself (for example, the duration of a page visit).
• Third Parties: Individuals or organisations not affiliated with our platform that may have access to personally identifiable information (PII) under certain conditions.

Acceptance of Terms

By accessing WeHouse, you affirm that you are at least 18 years old and consent to abide by the terms outlined below. By checking the "I have read and I agree to the Terms and Conditions" box during registration or by using our services, you acknowledge and agree to the Terms and Conditions and Privacy Policy in full. If you do not meet these requirements, or you disagree with the terms or privacy policy, you are prohibited from using our platform.

Fair Go Policy

Our Fair Go Policy is designed to ensure that all users can enjoy our services equally and without disruption. By using our platform, you agree to use our services responsibly and in accordance with the following principles:

• Do not engage in activities that unfairly burden, disrupt, or harm the platform or its users, such as excessive data usage, spam, or unauthorised access.
• Use the platform in a manner that is consistent with its intended purpose and in compliance with all applicable laws and regulations.
• Refrain from abusive behaviour, including harassment, discrimination, or any actions that negatively impact the experience of other users.
• Adhere to the terms outlined in this agreement, including guidelines for leaving reviews and respecting the privacy of others.

We reserve the right to limit, suspend, or terminate access to our platform if we determine that your actions violate this Fair Go Policy or otherwise compromise the integrity of our services.

Australian Residency Requirement

Our platform is intended for use by individuals who are residents of Australia. By registering for an account or using our services, you confirm that you are an Australian resident. If you are not a resident of Australia, you are not authorised to use our platform, and we reserve the right to suspend or terminate your account.

General Usage

Account Creation: To access certain features of our platform, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

User Responsibilities: You agree to use the platform responsibly and to comply with all applicable laws and regulations. You are responsible for safeguarding your account and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.

Prohibited Activities: You agree not to engage in any of the following prohibited activities on our platform:

• Posting other users' personally identifiable information (PII).

User-Generated Content

Ownership: You retain ownership of any content you create and upload to WeHouse, including but not limited to tenancies, reviews, and any other resources. However, by submitting content, you grant WeHouse a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such content and resources.

Responsibility for Content: You are solely responsible for the content you create and submit. WeHouse does not endorse any user-generated content and disclaims any liability for such content.

Malicious Behavior

Zero Tolerance Policy: We maintain a zero-tolerance policy regarding malicious behavior, including harassment, threats, abuse and/or the distribution of malware. We reserve the right to take appropriate measures, including suspension or termination of accounts, against any user engaging in such conduct.

Reporting Misconduct: If you encounter any content or behavior that you believe violates these terms, please report it to us immediately via our reporting system.

Right to Remove Content

We reserve the right, at our sole discretion, to remove or disable access to any content or user account that violates these Terms and Conditions or is otherwise objectionable. This includes, but is not limited to, content that is unlawful, fraudulent, threatening, abusive, defamatory, obscene, or otherwise harmful.

Data Removal and Retention

Right to Remove Data: You may request the removal of your personal data at any time by contacting us. We will process your request in accordance with applicable laws.

Data Retention: We may retain your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Discretionary Data Removal: We reserve the right to remove any data, at our discretion, that does not align with our principles, policies, or values, or that we deem inappropriate for our platform.

Leaving Reviews

When leaving reviews on our platform, you agree to adhere to the following guidelines:

• Reviews must not contain any personally identifiable information (PII), such as names, phone numbers, addresses, or any other details that could identify an individual.
• Reviews should not be directed at specific individuals, whether they are users or representatives of a business.
• Reviews must remain professional and constructive. Personal insults, offensive language, or defamatory statements are strictly prohibited.
• Reviews should focus on your experience with the product, service, or business and avoid unrelated commentary.

Failure to adhere to these guidelines may result in the removal of your review and, in some cases, the suspension or termination of your account.

Payments

By subscribing to one of our paid plans, you are responsible for ensuring that sufficient funds are available on your designated payment method by the due date indicated in the "My Subscriptions" section. As a courtesy, we will send a reminder email 3 days before the scheduled payment.

Refunds and Credits

If you feel like WeHouse doesn't work for you, you are welcome to request a refund at any time by contacting support. All refunds are calculated on a prorata daily basis and at this point, your subscription will be cancelled.

In the event that you downgrade your plan during an active subscription period, you will receive a prorated daily credit for the remaining balance. These credits will be reflected in your "My Subscriptions" section and will be applied to future subscription payments automatically. If you prefer to receive a refund for these credits, please contact support.

Payment Authorisation and Consent

By subscribing to our services or making a payment through WeHouse, you authorise WeHouse Pty Ltd to send instructions to the financial institution that issued your card to take payments from your card account in accordance with the terms of your agreement with us. This includes:

• Authorising one-off payments for services or subscriptions.
• Authorising recurring payments for ongoing subscriptions, where applicable, at the frequency and amount agreed upon during the subscription process.
• Adjustments to payment amounts as permitted under the terms of your subscription, such as prorated charges or discounts.

You are responsible for ensuring that sufficient funds are available in your designated payment method on the due dates. If a payment fails, WeHouse reserves the right to retry the payment, suspend your account, or terminate your access to services as outlined in these terms.

By agreeing to these Terms and Conditions, you acknowledge and consent to the payment authorisations described above.

Indemnification

You agree to indemnify and hold harmless WeHouse and its affiliates, officers, directors, and employees from any claims, damages, losses, liabilities, and expenses arising from your use of the platform or your violation of these Terms and Conditions.

Third-Party Links and Services

Our platform may include links to external websites or services not operated by WeHouse. WeHouse is not responsible for the content, policies, or practices of any third-party websites or services. We encourage you to review their terms and privacy policies before engaging with them. Your interactions with these third-party services are at your own risk.

Amendments to User Accounts

We reserve the right to make changes to user accounts, including access levels and subscription plans, to maintain the integrity of our platform or comply with legal obligations. In the event of such changes, users will be notified in advance whenever feasible. Continued use of the platform constitutes acceptance of these amendments.

Limitation of Liability for User-Generated Content

WeHouse is not responsible or liable for any content, resources, or materials posted, uploaded, or shared by users on the platform. This includes but is not limited to reviews, comments, tenancies, and other user-generated content.

While we reserve the right to monitor and remove any content that violates these Terms and Conditions or applicable laws, we do not guarantee the accuracy, reliability, or quality of user-generated content. All such content represents the views and opinions of the user and does not reflect the views of WeHouse.

Users are solely responsible for the content they create and share, and any reliance on user-generated content is at your own risk.

Advice and Information Disclaimer

Any advice, guidance, or information provided by WeHouse, whether through the platform, support channels, or any other means, is intended for general informational purposes only. While we strive to ensure the accuracy and reliability of the information provided, it should not be considered professional, legal, financial, or other expert advice.

Users are solely responsible for verifying the accuracy and suitability of any advice or information before taking action. WeHouse disclaims all liability for actions taken or not taken based on the information provided, including but not limited to potential errors, omissions, or changes in circumstances.

Feedback and Suggestions

This includes but is not limited to natural disasters, acts of government, cyber attacks, strikes, power outages, or interruptions in telecommunications or utilities. In such circumstances, we will make reasonable efforts to restore services as soon as possible.

Dispute Resolution

In the event of a dispute arising from your use of the platform, we encourage you to contact us directly to resolve the matter amicably. If a resolution cannot be reached, disputes shall first be referred to mediation or arbitration in accordance with the laws of Queensland, Australia. If these methods fail, disputes may be submitted to the courts of Brisbane, Queensland, as a last resort.

Severability

If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will continue in effect.
